Please read these terms carefully before booking a shipment. They define the legal relationship between you (the Shipper) and Africargo Worldwide Ltd (the Carrier).
Table of Contents
1 Definitions
In these Conditions, the following definitions apply:
- "Carrier" means Africargo Worldwide Ltd, its subsidiaries, and its authorized agents.
- "Shipper" (or "Consignor") means the person or entity who contracts with the Carrier for the shipment of goods.
- "Consignee" means the person or entity to whom the goods are to be delivered.
- "Shipment" means all documents or parcels that travel under one waybill number.
- "Prohibited Items" means items banned by law or by the Carrier's regulations (e.g., explosives, illegal narcotics).
2 Scope of Service
Africargo Worldwide Ltd provides freight forwarding and logistics services, including Air Freight, Sea Freight, and Door-to-Door delivery.
The Carrier reserves the right to:
- Inspect any shipment without prior notice to the Shipper for safety, security, customs, or regulatory reasons.
- Refuse any shipment that does not comply with these Terms, applicable laws, or safety standards.
- Subcontract the whole or part of the carriage to third-party airlines, shipping lines, or hauliers.
3 Rates & Payment
Calculation: Rates are calculated based on the greater of actual weight or volumetric weight. Volumetric weight is calculated using the standard IATA formula (L x W x H / 6000 for air).
Payment Terms: All freight charges, duties (if applicable), and fees must be paid in full prior to the shipment departing the UK, unless a credit account has been pre-approved in writing.
Note: Unpaid shipments will be held at the destination warehouse. Demurrage (storage fees) will accrue daily after the free period (typically 3 days).
4 Shipper's Obligations
The Shipper warrants that:
- The goods are properly packed to withstand normal transport handling.
- The goods are accurately described on the Waybill and Commercial Invoice.
- The shipment contains no Prohibited Items.
- The Consignee's contact details (specifically phone number) are correct.
The Shipper agrees to indemnify the Carrier for any costs, damages, or fines resulting from the Shipper's failure to comply with these warranties.
5 Prohibited Items
The Carrier does not accept the following items under any circumstances:
Items restricted by IATA (e.g., lithium batteries, perfumes) may be accepted only if declared and packed according to Dangerous Goods regulations.
6 Limitation of Liability
Delay: The Carrier is not liable for delays caused by Customs inspections, force majeure (e.g., weather, strikes, war), or airline schedule changes.
Loss/Damage: Unless additional insurance is purchased, the Carrier's liability for loss or damage is limited to the lesser of:
- The actual value of the goods; or
- $20.00 USD per kilogram (Air Freight) or $500.00 USD per package (Sea Freight).
The Carrier is NOT liable for consequential loss (e.g., loss of profit, income, or business opportunity) under any circumstances.
7 Insurance
Standard shipping rates do not include "All-Risk" insurance.
The Shipper is strongly advised to purchase Goods in Transit insurance, particularly for high-value items such as electronics, jewelry, or commercial samples. The Carrier can arrange this insurance upon request for an additional premium.
8 Claims Process
Any claim for loss or damage must be notified in writing to the Carrier within:
- Damage: 7 days from the date of delivery.
- Loss: 14 days from the expected date of delivery.
No claim will be processed until all shipping charges have been paid in full.
9 Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the English courts.
